Privacy Notice
Controller: Renato Pozo (Latitud Cero Studio), Quito, Ecuador. Email: latitudcerostudio@gmail.com.
What we collect: what you write in our forms (name, email, country, plan, idea or message) and what you send us by email or WhatsApp. If you hire us, we also collect your billing and payment details (PayPal or bank transfer). We do not use analytics or advertising cookies.
Approximate location: to show you the right prices and taxes, the site uses your IP address only during your visit to estimate your country. We do not store it, although our host (Netlify) may keep it briefly in its technical logs. If that fails, the site uses your browser's time zone, only on your device: it is not stored and never reaches us. Legal basis: our legitimate interest in showing you the right prices. If you send us the form, it includes your approximate location, but not your IP address, so we can prepare your proposal.
Why we use it:
- To reply to you and send your proposal. Legal basis: your request and steps prior to a contract.
- To build your site, charge you and issue invoices. Legal basis: the contract and our tax obligations.
If you contacted us or are a client, we do not send you marketing unless you ask for it. For businesses we contact for the first time, the next section applies.
Reaching out to businesses (prospecting): we sometimes write for the first time to businesses that may need a website, automations or a web tool.
- What data: only business details the company itself publishes: business name, website, city and country, company email and, if listed there, the contact person's name and role. We also keep our notes on their public website and the preview we prepared for that business.
- Where it comes from: public sources, such as the company's website, its Google business profile or business directories. We record where and when we found each item. We never buy lists or use address-harvesting software.
- Legal basis: our legitimate interest in offering other businesses services related to their activity (Ecuador's LOPDP; Article 6(1)(f) of the GDPR and the UK GDPR). In the UK we only email incorporated companies (PECR). In Canada, only conspicuously published addresses without a statement refusing messages (CASL). In Australia and New Zealand, with consent inferred from publication.
- Unsubscribing: every email tells you how to unsubscribe in one step: just reply "no thanks" or "UNSUBSCRIBE". We act on it within 5 business days and never write to you again. You can also object at any time by writing to latitudcerostudio@gmail.com.
- How long: if there is no reply, we delete the data 12 months after the last contact. If you unsubscribe, we keep only your email on a suppression list so that we never contact you again.
- Your rights: the same as in "Your rights" below.
How long we keep it:
- Requests that do not become a contract: up to 12 months.
- Client data: for as long as the service lasts, then for the period tax law requires (up to 7 years for invoices).
Who we share it with: only the providers we need to operate: Netlify (site and form hosting), Google (email), Meta (WhatsApp), Anthropic (Claude, the AI we use to prepare proposals and sites, without your data being used to train its models), Notion (our record of requests, clients and businesses we contact), OpenAI (ChatGPT, which we use to find businesses in public sources), PayPal (payments) and, if your site runs on Wix or Shopify, those platforms. Some of them are outside Ecuador, for example in the US, and protect data under their own contractual safeguards. We never sell data.
Your visitors' data: if your site collects data from your visitors (bookings, forms), you are the controller. We act only as your processor: we use that data only to provide our service, we do not share it, and we delete it when the service ends.
Your rights: you can ask to access, correct, delete, port or restrict your data, or object to its use, by writing to latitudcerostudio@gmail.com. We reply within 15 days. You can also complain to Ecuador's Superintendencia de Protección de Datos Personales. If you are in the EU or the UK, you can also complain to your local data protection authority. California residents can also exercise their rights under the CCPA through the same email. We do not sell or share personal information for advertising.
Children: this site is not directed at children, and we do not collect their data.
